These terms and conditions contain legal obligations. Please read these terms and conditions carefully before using this site.

CONDITION OF SALE

This ticket is sold by TOA Global Pty Ltd (“Seller”) who is responsible for TOA Global Events  (“event”) for which it is sold. All claims are the sole responsibility of the Seller. The ticket is sold subject to the Seller’s conditions of sale, subject to the following conditions:

  1. No refunds or exchanges on any ticket and/or transaction, except as may be provided by these terms and conditions.
  2. The right is reserved to add, withdraw or substitute speakers and/or vary advertised program, seating and audience capacity.
  3. The right of admission is reserved. Camera and tape recorders may not be permitted. Resort or Venue admission rules apply. 
DISCLAIMER

You expressly understand and agree that: (a) this site and any of the services are provided on an “as is” and “as available” basis and that this site makes no warranties, representations or conditions (as used in this section “warranties”) of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement and that any such warranties are hereby expressly disclaimed, and (b) this site specifically makes no warranties that any of its services, including any content, information, products or services obtained from or through the use of this site or any of the services, will be provided on an uninterrupted, timely, secure or error-free basis or that such services or the results derived therefrom will meet your requirements or expectations.

LIMITATION OF LIABILITY

You expressly understand and agree that in no event shall the Seller, including its affiliates and licensors, be liable for any damages whatsoever, including any direct, indirect, incidental, consequential, special or exemplary damages, and any damages for loss of profits, savings, goodwill or other intangible losses, regardless of whether the Seller had been advised of or could have foreseen the possibility of such damages, arising out of or in connection with: (a) the use, inability to use or performance of any of the services of this site, or (b) any unauthorized access to or modification to any of your content or transmissions, or (c) any other matter relating to this site or any of the services.

REFUND, EXCHANGES AND REPLACEMENTS POLICY

Seller does not offer refunds or exchanges as a result of a change in your personal circumstances, or you made your booking by mistake, or it is no longer wanted or needed, or due to external factors such as, for example, adverse weather. Seller will only provide a refund if: (a) your Master Services Agreement with the Seller is cancelled or terminated prior to the Event; or (b) you are unable to attend your booking due to illness/ injury and have provided the evidence to support the existence of such illness/injury; (c) or to the extent otherwise required by law (including the Australian Consumer Law).

If the event is cancelled, rescheduled, and relocated, the Seller will automatically apply your ticket to the next rescheduled and relocated event.

If an event is cancelled, rescheduled or significantly relocated by the Seller, all liability is limited to the amount for which the ticket was purchased (including any fees or charges unless otherwise notified at time of purchase). Unless required by law (including the Australian Consumer Law), the Seller shall not be liable for any other losses incurred by you as a result of the cancellation, rescheduling or relocation of an event, including any travel and accommodation expenses.

Seller will only replace lost, stolen, damaged or destroyed tickets if the authenticity of the ticket can be verified, including proof of purchase, and if you give reasonable notice before the event. Seller may charge a reasonable fee for the replacement of tickets. Seller may not replace tickets where seating is unallocated.

You should carefully consider the refund and cancellation policies of travel, accommodation and other goods or service providers when making arrangements for attendance to the event. You may also wish to consider taking out a relevant insurance policy to cover for any losses in the event of cancellation, rescheduling or relocation;

RESALE OF TICKETS

Tickets may not, without the prior written consent of the Seller, be resold or offered for resale at a premium (including via on-line auction or other unauthorized resale sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If a ticket is sold or used in breach of this condition, the ticket may be cancelled without a refund and the ticketholder of the ticket may be refused admission.

VARIATION TO TERMS AND CONDITIONS

Seller may vary these Terms and Conditions at any time by updating them. Any variations will only apply to ticket purchases made after these Terms and Conditions have been updated.
